DevaCurl may offer “Subscribe & Save” programs for certain items. These Subscription Terms govern your subscription(s) with DevaCurl (each a “Subscription”). These Subscription Terms are part of our Terms & Conditions and are expressly incorporated into our Terms & Conditions by reference, and these Subscription Terms and our Terms & Conditions govern all Subscriptions, in addition to our Privacy Policy, our Returns Policy, and any other applicable terms, conditions, limitations, and requirements on the DevaCurl.com website (as changed over time). By placing any Subscription order, you accept these Subscription Terms. Please read them carefully. For more information about subscriptions, please see our Subscription FAQ.

1. Subscription Benefits. DevaCurl Subscriptions offer you discounts on certain DevaCurl products and shipping. Our Site indicates whether DevaCurl products are or are not eligible for Subscriptions, and any Subscription discounts offered for eligible products. DevaCurl reserves the right to change Subscription benefits at any time in its sole discretion, including discount amounts, shipping discounts, and/or eligibility. Subscription details may also change over time, such as (without limitation) item price, taxes, availability, and/or shipping charges or shipping discounts. Such changes will apply to all subsequent Subscription orders after they take effect.

2. Subscription Orders. You must create a DevaCurl account on our Site to enroll in a Subscription with us. When you enroll in a Subscription, your first order will be processed immediately and the payment method you have provided will be charged at the time the order is placed. After that, your Subscription will automatically create a new order according to your chosen delivery schedule, until you cancel or otherwise modify your Subscription. Your Subscription remains in effect until it is cancelled.

You may skip, pause, or cancel future Subscription orders at any time up to forty-eight (48) hours prior to the next order’s scheduled shipment date. If you skip, pause, or cancel within forty-eight (48) hours of your next Subscription order’s shipment date, your next Subscription order will be automatically authorized and you will be charged as further described in the “Payment Authorization for Subscription Orders” section below – but future Subscription order(s) after that will be skipped, paused, and/or cancelled as directed by you. To skip, pause, or cancel future Subscription orders, log in to your DevaCurl account and select “Manage Subscriptions.”

Subscription shipments are contingent upon item availability; no substitutions may be made and if an item is not available, we are not obligated to ship it or any substitute to you. We may, in our sole discretion, terminate your Subscription at any time without notice. If we do so, you will only be charged for orders that have been shipped to you.

All Subscription orders are subject to DevaCurl’s Returns Policy.

3. Payment Authorization for Subscription Orders. By enrolling a Subscription with us, you expressly permit DevaCurl to charge your provided payment method on a recurring basis, as well as the amount of the charge, all at the frequency and quantity you selected. On each Subscription order shipment date, your order will be automatically authorized and charged. The amount charged will reflect the price of your item(s) (less any Subscription discounts), plus any applicable taxes. You authorize us to make such recurring charges for Subscription orders to the payment method you provided when creating your Subscription, without further authorization from you, until you direct otherwise.

Any changes to your payment method will apply only to a Subscription order only if made at least forty-eight (48) hours prior to that order’s scheduled shipment date. If we are unable to complete any Subscription order with the payment method you used to create your Subscription, you authorize us to update your subscription with another payment method in your account, and to charge the payment method for your Subscription orders.

4. Changes to Subscription Terms. In addition to any other rights we may have under these Terms & Conditions, we may, in our sole discretion, change these Subscription Terms without notice to you. If any change to these Subscription Terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED PARTICIPATION IN A SUBSCRIPTION (INCLUDING, WITHOUT LIMITATION, ANY RECEIPT OF SUBSCRIPTION ORDER(S)) AFTER WE CHANGE THESE SUBSCRIPTION TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR SUBSCRIPTION(S).
